Please read this contract carefully as it constitutes a legally binding agreement. Kindly initial each paragraph and complete all fields on the final page. All information requested is required. If any section is unclear or unacceptable, please contact Mutts and Misfits for clarification before signing. Definitions: Adopter - Person adopting from Rescue who is 18 years or older. Animal - The dog being adopted, as described below. Approved Residence - The Residence listed in this Agreement, or any other residence pre-approved by Rescue in writing. Veterinarian - A licensed veterinarian chosen by the Adopter.

Terms & Conditions*
- Adoption - Rescue agrees to adopt the Animal to Adopter, and Adopter agrees to adopt the Animal from Rescue, subject to the terms and conditions of this Agreement. Adopter understands that donations and adoption fees are non-refundable. If the Animal is returned within 30 days from adoption date Adopter will receive a credit for the adoption fee that can be applied to the adoption of another animal. - The Rescue represents that it has the right to transfer ownership of the Animal.
- Animal Care - Adopter agrees to provide the Animal with the following: - Clean, fresh water at all times. - High-quality pet food appropriate for the Animal's age and health. - The Adopter agrees to provide a safe and humane living environment for the Animal, which includes adequate protection from the elements and a safe and secure environment. - Proper veterinary care, including annual checkups, vaccinations, and parasite prevention. - Prompt veterinary attention in case of illness or injury. - Regular exercise and playtime. - Proper training and socialization to ensure the Animal's well-being and safety. - The Adopter agrees to keep the Animal on a leash or in a carrier when outside the home and in public places, unless in a designated off-leash area. - The Adopter agrees to never leave the Animal unattended in a vehicle or outdoors in extreme temperatures. - The Adopter agrees to give the Animal a fair chance, 30 days, to adjust to its new home. - The Adopter agrees to follow the Slow Introductions Guideline, Exhibit A, for introducing the Animal to any other animal within the home.
- Financial Responsibility - Adopter agrees to be solely financially responsible for all costs associated with the Animal's care, including food, veterinary care, training, grooming, and any other related expenses with the exception of spay or neuter, if applicable. Spay and neuter costs will be covered by the Rescue at a Veterinarian of the Rescue’s choosing.
- Identification - Adopter agrees to keep the Animal properly identified with a collar and ID tag or microchip at all times. If microchipped, Adopter agrees to register the microchip in their name within 7 days. Microchips must also be updated within 7 days of Change of Residence.
- Leash Law - Adopter agrees to comply with all applicable leash laws and keep the Animal leashed when outside the confines of a securely fenced property.
- Change of Residence - Adopter agrees to notify Rescue within 7 days of any change in Residence. Rescue may conduct a pre-approval inspection of the new residence.
- Transfer of Ownership - The Adopter agrees to not sell, give away, or transfer ownership of the Animal to any other person or entity.
- Death of Animal\Missing Animal Notification - I will notify the Rescue within twenty-four (24) hours should the Animal die or go missing.
- Return of Animal - If the Adopter can no longer care for the Animal, Adopter agrees to return the Animal to Rescue. Rescue will make a reasonable effort to rehome the Animal. The Adopter agrees to never abandon the Animal or surrender it to a pound or Shelter or Rescue other than Mutts & Misfits.
- Default - If the Adopter breaches any term of this Agreement, Rescue may, at its sole discretion, repossess the Animal and Adopter is liable for all costs which Mutts & Misfits incur while obtaining information, Animal, or rehome of Animal.
- Disclaimer of Warranties - The Animal is adopted "as is." Rescue makes no representations or warranties regarding the Animal's health, temperament, or behavior. Adopter understands that animals in foster care or care at the Rescue may have been exposed to potentially contagious diseases, including but not limited to, kennel cough in dogs. Treatment, if necessary, will be the responsibility of the Adopter. This illness can spread to existing pets of the same species.
- Applicable Laws, Codes, Regulations, Bylaws - Adopter agrees to understand the rules and regulations for their area. This includes city ordinances, county leash laws, state licensing requirements, and any specific regulations set by your HOA.
- Right to visit - Adopter will permit an authorized officer of the Rescue, with notice (48 hours), to visit Animal residence, to be assured that the Animal is being treated in accordance with Animal Care had the general appearance of not being neglected and not in breach of Prohibitions.
- Entire Agreement - This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
- Severability - If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.
